If TERRATOURS is not advised of any error, omission or inexactitude, the travel agency shall be deemed to have requested the tickets or other travel documents in the form and manner in which they were issued, and shall be solely liable to its client(s) for any damage and additional cost resulting therefrom. IN CASE OF ANY ERROR, OMISSION OR INEXACTITUDE MADE OR COMMITTED BY TERRATOURS, TERRATOURS’S SOLE RESPONSIBILITY SHALL BE TO USE ITS BEST EFFORTS TO ATTEMPT TO CORRECT SUCH ERROR, OMISSION OR INEXACTITUDE, AND TERRATOURS SHALL NOT BE HELD LIABLE FOR ANY DAMAGES IN THE EVENT IT IS UNABLE TO DO SO. Any cancellation of a reservation at the request of a traveler or his travel agent and whatever the reason given (personal reasons, acts of terrorism, disturbances or fears of political unrest, natural disaster, etc …) will automatically lead to cancellation fees. Except for stays in Italy: the stay is 100% non-refundable for any cancellation less than 90 days before departure. In order to receive a refund, if applicable, you must send us all relevant documents. To establish the cancellation period, the day of departure is not taken consideration. If the cancellation of one or more passengers changes the occupancy base of the room (s) for the passenger (s) still traveling, the latter (s) will have to pay the amount of the difference resulting from such changes. In all cases where a passenger wishes to modify, change or cancel his package, he must send a written notice to TERRATOURS through his travel agency, within the time limit. No reimbursement will be granted by TERRATOURS for canceled or unused services after the departure of the traveler.

Once your reservation has been confirmed by TERRATOURS, any modification or correction to the arrangements already made (change of dates, flights, destination or name spelling) will be subject to availability and will incur the following charges: 45 days or more before departure: $ 100 per person, per change • 30 days or less before departure: your change will be considered a cancellation and subject to the associated fees.

Air: In addition to the carrier’s penalties (if applicable), service fees of $50 per ticket plus taxes apply to each void, refund, reissue or exchange, in cases where the airline accepts to void, refund, reissue or exchange a ticket.

Any additional fees charged by hotels, service providers, couriers, credit card issuers, in addition to the communication charges, will be payable to TERRATOURS

TERRATOURS strongly recommends the purchase of complete cancellation, luggage and medical insurance in order to be well protected in case of sickness, cancellation and/or loss or damage of luggage.

Insurance related to the client’s home, work or credit card are generally inapplicable or incomplete for the purposes of travel. TERRATOURS is released from any liability whatsoever for the costs and damages resulting from the refusal to purchase travel insurance.

TERRATOURS strongly encourage the client to consult a traveler’s health center before your departure.

Hotel rooms will be assigned upon arrival. Bedding type and special requests cannot be guaranteed and no refund will be given in the event that the hotel is unable to fulfill the request(s) made. Bedding type and special requests are at the discretion of the hotelier and will be allocated based on availability at check-in. TERRATOURS will not be responsible if hotels do not comply.

If, for reasons beyond our control, the accommodations described in the TERRATOURS brochures are not available, TERRATOURS and its agents reserve the right to relocate their clients to other hotels of a similar or superior quality.

TERRATOURS confirmations for single, double/twin, triple or quad rooms only refer to the number of full paying passengers. The confirmations do not refer in any way to the number or type of beds within the room. TERRATOURS cannot guarantee special requests and will take no responsibility if hotels do not comply.

Validity Period for Prices and Services

The prices indicated in our brochures are valid for a period of 60 days after publication of any brochure. For prices applicable to all reservations made after the initial 60 days, please consult our representatives. TERRATOURS reserves the right to modify prices without notice. Published prices may occasionally be higher than those advertised by hotels.

Please note that the price of the products or services sold can only be increased following the imposition of a fuel surcharge by the carrier or an increase in the exchange rate, to the extent that the applicable exchange rate 45 days before the date of supply of services has increased by more than 5% since the date the contract was concluded. In the event that the price increase, without taking into consideration the increase in the Québec sales tax or the goods and services tax of Canada, is equal to or greater than 7% of the price of the services, the client may choose between full and immediate reimbursement of services or the provision of similar services. No price increase can occur in the 30 days preceding the date the services are to be rendered. The price of the services similar to those sold to the customer could be reduced by the supplier (s) after the purchase by the customer. The customer does not benefit from the discount since it only applies to the new purchase (s).

TERRATOURS and its employees and agents act only as representatives of the passengers and accept no responsibility for the passengers or for the quality of services provided in hotels, on board aircraft, trains, buses or any other vehicle used in connection with the trip, nor for delays, luggage loss or damage, or accidents incurred by passengers resulting from the use of these means of transportation, whatever the cause. If, for the comfort or well-being of passengers or for any other reason, it becomes necessary or advisable to change itinerary or arrangements, these changes will be made without any penalty to the operators. Passengers will bear the additional expenses, if any. Conversely, a refund will be paid out if the changes result in savings.

The seats for the transportation ways are assigned exclusively by the carrier and TERRATOURS cannot in any way guarantee a particular seat. In the case of air transportation, YOU MUST present yourself up at the check-in counter at the airport at least THREE HOURS before the scheduled departure time otherwise you may lose your reservations and your seats may be canceled and assigned to other travelers, without any recourse against TERRATOURS. TERRATOURS DISCLAIMS ANY LIABILITY FOR ANY LOSS OR DAMAGE RESULTING FROM THE DELAY OF ANY CARRIER OR ANY CHANGE IN SCHEDULE, ROUTE OR STOPOVER, FOR ANY REASON WHATSOEVER, and shall not be liable for any accident or an event occurring while the passenger is on board of any transport type. In addition to the general conditions stated above, the following provisions apply for tourism travel abroad: Tour Operators: the tours abroad are not operated nor directed by TERRATOURS, but by operators and / or local suppliers whose names appear on your vouchers. Transfers on arrival and departure are made by drivers and do not systematically include the services of local guides. Drivers’ role being limited to your transport between two points, they are not required to speak in English. Hotels are subject to availability at the time of booking and may be replaced by others of similar category. The rooms are allocated by the hoteliers according to the availability at the time of the arrival of the passengers. TERRATOURS has no control over the size, location or view of the rooms assigned to passengers. Single Rooms: Single rooms in Europe are generally smaller and less well located than double rooms. Their number is very limited and they will only be confirmed after booking. None of the services or benefits described in a package can be considered as a determining factor in the choice of the traveler or as the main consideration for a booking. Terratours’ liability for failure to provide a service or benefit described in this brochure is limited to the cost of such services or benefits.
